Why

Three: a mistake about a fact constituting the offence, a mistake about a qualifying fact or an aggravating circumstance, and a mistake about the unlawfulness of the act. The middle paragraph is the one students forget, and it does the quiet work of stopping an aggravation being applied to someone who did not know the fact that grounds it.
